Distance sales contract
The terms under which Albiferro sells its software licences and subscriptions online.

1. Parties

Buyer: the person or company whose name, address, e-mail and tax details are given in the order.
2. Subject
This contract covers the software licences, SaaS subscriptions and related digital services (together “products”) the Buyer orders online from the Seller, including through the product sites Spitfire, Milk Trace, Courino (KOS). It is made under Consumer Protection Law No. 6502 and the Distance Contracts Regulation. The product, plan, term, quantity, price including VAT and the payment method are shown on the order page and in the pre-contract information before the Buyer confirms the order.
The plan terms published on each product’s site (plan limits, renewal, upgrades, add-ons) complete this contract; the version in force on the order date applies.
3. Price and payment
- Prices are shown with VAT where VAT applies. The price shown at confirmation is final for that order.
- Card payments are processed by PayTR Ödeme ve Elektronik Para Kuruluşu A.Ş. under 3D Secure; card details are entered on PayTR’s page and never reach or are stored by the Seller.
- Where offered, bank transfer is paid against a proforma invoice within its stated validity.
- The invoice (e-Archive or e-Invoice) is sent to the Buyer’s e-mail address.
4. Delivery
Products are delivered electronically: by e-mailing the licence key or opening account access, normally right after the payment is confirmed and in any case within 30 days. Nothing is shipped physically. Delivery is complete when the key or access is sent to the e-mail address in the order.
5. Subscriptions
A subscription renews at the end of each period at the price agreed until it is cancelled. The Buyer can cancel at any time with the link in the subscription e-mails or by writing to [email protected]; cancellation takes effect at the end of the current period, and no further payment is taken.
6. Right of withdrawal
Under Article 15(1)(ğ) of the Distance Contracts Regulation, digital content delivered instantly in electronic form is excluded from the right of withdrawal once delivered; the Buyer confirms this separately when ordering. 7. Buyer’s obligations
The Buyer gives correct order and invoice details and uses the products within their licence terms. A licence key is for the Buyer’s own use and may not be resold or shared with third parties.
8. Personal data
Personal data given with the order is processed to perform the contract, issue invoices and meet legal obligations, as set out in the privacy notice of the product site the order was placed on and in our privacy notice.
9. Disputes
Consumer buyers may apply to the consumer arbitration committee or consumer court of their place of residence or of the place of the transaction, within the monetary limits set each year by the Ministry of Trade. For buyers who are not consumers, Ankara courts and enforcement offices have jurisdiction.
10. Entry into force
The contract enters into force when the Buyer confirms it electronically at checkout. A copy is sent to the Buyer’s e-mail address with the order. The Turkish text prevails.
